Data recording and archiving

Pursuant to Article 630f of the German Civil Code (BGB), the MVZ Gamma Knife Center Krefeld and the MVZ Gamma Knife Center Hanover are obligated to document treatments administered to patients. This may be in the form of hard copies or electronic patient files. Statutory regulations such as the Radiation Protection Ordinance or the X-Ray Ordinance also prescribe different documentation retention periods. Your patient file is therefore retained for up to 30 years for liability reasons. The use of electronic data processing is also prescribed in relation to health insurance companies on a statutory basis, e.g. German Social Security Code (SGB V) Article 291a.
Under Article 6 of the GDPR , as a patient, processing of your data is always lawful if you have either consented to such processing or processing is necessary for compliance with a legal obligation. The latter is always the case whenever the MVZ acts in a medical capacity.

Your rights regarding the processing of patient-related data.

You have the right to access data stored in the MVZ that relates to you. (Art. 15 GDPR). As data is stored and processed solely for the purposes of diagnosis and therapy, a legal storage obligation exists (see above). In this respect, your right to data erasure under Art. 17 GDPR is usually restricted.

You have additional rights arising out of the GDPR. However, please note that the GDPR was essentially enacted to combat unauthorized data use and forwarding on the Internet and not to prevent the expedient use of electronic data processing in medical diagnostics and therapy.
Therefore, most rights arising out of the GDPR are limited by law in relation to medical diagnostics and therapy.
